Welcome to EatFood.Live! Please read these Terms of Service ("Terms") carefully before using our website eatfood.live and our services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using EatFood.Live, you agree to these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you do not agree to all of these terms, do not use our services.

2. Services Offered

EatFood.Live is a frozen food delivery service specializing in sous-vide cooked meals. We offer a variety of meal options, including:

  • 'Sous Vide' Fire Braised Chicken with Fresh Broccoli & Cherry Tomatoes
  • 'Sous Vide' Salmon with Fresh Broccoli & Cherry Tomatoes
  • 'Sous Vide' Steak & Potato Mash with Fresh Broccoli & Cherry Tomatoes
  • 5 different Gourmet Pizzas

Meals are available for purchase in quantities of 6, 8, 10.

3. Ordering and Subscription

Orders: You can place orders for our meals through our website. All orders are subject to acceptance by us, which is at our sole discretion.

Subscription: We offer a subscription service for recurring meal deliveries. By subscribing, you agree to recurring charges for an ongoing service. You will be charged at the subscription price, including any applicable taxes and shipping fees, until you cancel your subscription in accordance with our cancellation policy (see Section 8). Our subscription plans are intended for customers seeking regular deliveries; for single orders, please use our "One-Time Purchase" option. Subscription discounts are applied as described on our website, including discounts on the fourth week of subscription.

Subscription Benefits: Subscribers receive discounted pricing per meal and may be eligible for further discounts or free meals on their fourth week of subscription, depending on the meal quantity selected (see Pricing Structure on our website for details).

4. Pricing and Payment

Pricing: Meal prices are listed on our website and are subject to change without notice. Prices may vary for subscription and non-subscription purchases.

Payment: Payment is due at the time of order. We accept various forms of payment as indicated on our website. You represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including any applicable taxes and shipping fees).

5. Promotional Offers and Discounts

All promotional offers, discounts, and coupon codes are subject to specific terms and conditions provided with the offer. Unless otherwise stated, promotions are limited to one per customer or household, may not be combined with other offers, and are not valid on prior purchases. We reserve the right to modify or cancel any promotion at any time without notice. Any fraudulent use or abuse of promotional offers, including the creation of multiple accounts to redeem a new-customer offer, is strictly prohibited. If an account is found to be in violation of these terms, EatFood.Live reserves the right to charge the customer's payment method for the full value of any promotional discounts applied to their orders, in addition to pursuing other remedies such as account suspension or termination.

6. Promotion Abuse & Fraud Prevention

One-Per Policy. Promotional pricing (including “first-box” or “new-customer” offers) is limited to one (1) per household, delivery address, payment card, IP address, and device.

No Multiple Accounts. Creating, or encouraging others to create, multiple accounts to obtain additional promotional pricing is strictly prohibited. We reserve the right to merge, suspend, or terminate such accounts and to charge the full, non-promotional price for any orders placed in violation of this policy.

Retroactive Price Adjustment. By accepting a promotional offer, you authorize EatFood.Live to charge your payment method on file for any difference between the promotional price paid and the then-current standard price if we determine that the offer was obtained or used contrary to these Terms.

Fraud Screening. All orders are subject to automated and manual fraud-prevention checks. We may delay or cancel an order, or require additional identity verification, if fraud is suspected.

7. Shipping and Delivery

Shipping: We ship from Las Vegas. Shipping costs are calculated based on the destination state and shipping method selected at checkout. Available shipping methods are Ground Shipping ($12.99) and Air Shipping ($25.99).

Delivery: We aim to deliver your order within the estimated delivery timeframe provided at checkout. However, delivery times may vary and are not guaranteed. We are not responsible for delays caused by events beyond our control, such as weather conditions or carrier issues.

Warning: Your package may contain dry ice to keep your meals frozen during transit. Do not touch dry ice with your bare hands as it can cause severe skin damage. Follow the handling instructions included in the packaging. EatFood.Live is not responsible or liable for any injuries or damages resulting from the improper handling of dry ice.

8. Food Safety, Handling, and Allergens

Food Handling: Upon delivery, you are responsible for immediately and properly storing the food products. Please follow all food safety instructions provided on our packaging and website. You are responsible for the safe handling and cooking of all meals.

Allergen Information: Our meals are produced in a facility that also processes common allergens, such as milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, and soy. While we take steps to minimize the risk of cross-contamination, we cannot guarantee that any of our products are safe to consume for people with severe allergies. It is your responsibility to review the ingredient information and be aware of your own dietary needs and restrictions.

9. Cancellations and Modifications

Order cancellations or modifications may be possible depending on the order status. Please contact customer support as soon as possible if you need to cancel or modify your order. We will do our best to accommodate your request, but cannot guarantee cancellations or modifications once an order has been processed.

Subscription Commitment and Cancellation Policy: Promotional offers for subscriptions are provided with the expectation of an ongoing service. To protect against misuse, subscriptions with promotional pricing are subject to a minimum commitment.

  • Minimum Commitment: To receive promotional pricing on your first order, you are required to complete a minimum of two (2) paid deliveries.
  • Early Cancellation: If you cancel your subscription after receiving only one promotional order but before fulfilling the two-delivery minimum, you agree that the price of your first box will be retroactively adjusted to our standard, non-promotional rate. You will be charged the difference between the promotional price you paid and the full retail price of $13.99 per meal, plus the full cost of shipping for that order. By accepting a promotional offer, you authorize EatFood.Live to charge this price adjustment to your payment method on file.
  • Standard Cancellation: After your second paid delivery, you are free to cancel your subscription at any time before your next billing date without any penalty.
  • One-Time Orders: If you do not wish to commit to a subscription, please select our "One-Time Purchase" option to receive a single order at the standard price.

This policy is in place to allow us to offer great discounts to our loyal subscribers. Please note that pausing your subscription is different from cancelling and is subject to the terms below.

Pausing and Resuming Your Subscription: You may pause your subscription at any time. To avoid being charged for your next delivery, this change must be made at least five (5) days prior to your next scheduled delivery date. You will not be charged for any skipped deliveries. Your subscription can be resumed at any time by selecting "Resume Week" or "Unpause" in your online account portal or app.

10. Our "100% Satisfaction Guarantee" on Product Quality

At EatFood.Live, we are committed to delivering high-quality products that meet our rigorous standards. Our Satisfaction Guarantee pertains to the condition of your order upon arrival. We guarantee that your meals will be delivered cold, securely packaged, and free from spoilage or damage.

This guarantee does not cover subjective taste preferences. As taste is personal and varies for each individual, we cannot offer refunds or replacements based on a dislike of a meal's flavor profile.

If your order does not meet our quality standards upon arrival (e.g., the package is damaged, food has thawed, or shows signs of spoilage), please contact our customer support team at [email protected] within 48 hours of delivery. To help us resolve the issue quickly, please provide your order number and include clear photographs of the product and packaging in question.

Upon verification of a valid quality issue, we will work with you to find a suitable resolution. Resolutions are handled on a case-by-case basis and may include a replacement shipment, a credit for a future order, or another remedy we deem appropriate. Refunds will only be issued at the sole discretion of EatFood.Live. Please note that this policy does not affect your right to pause or cancel your subscription at any time, subject to our cancellation policy outlined in Section 8.

11. Intellectual Property

The content on our website, including text, graphics, logos, images, and software, is the property of EatFood.Live or its licensors and is protected by copyright and other intellectual property laws. You may not use our content without our express written permission.

12. User Conduct and Right to Terminate

You agree not to misuse our services or help anyone else to do so. You agree not to engage in any activity that is fraudulent, abusive, or in violation of these Terms, including but not limited to, exploiting promotional offers, abusing our refund or guarantee policies, or creating multiple accounts to circumvent these terms. We reserve the right, in our sole discretion, to refuse service, suspend or terminate your account, and cancel any orders if we believe your conduct violates these Terms, is harmful to our interests, or for any other reason.

13. Disclaimer of Warranties

Our services and all content, products, and services included on or otherwise made available to you through our website are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that our services will be uninterrupted or error-free, that defects will be corrected, or that our website or servers are free of viruses or other harmful components.

14. Limitation of Liability

To the fullest extent permitted by applicable law, EatFood.Live shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use our services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; or (e) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, transmitted, or otherwise made available through our services.

In no event shall EatFood.Live's aggregate liability for all claims relating to our services exceed the amount you paid to EatFood.Live in the 12 months prior to the event giving rise to the liability.

15. Indemnification

You agree to indemnify, defend, and hold harmless EatFood.Live, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms of Service or your use of our services.

16. Dispute Resolution by Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS. Most customer concerns can be resolved quickly and to the customer's satisfaction by contacting our customer support at [email protected]. In the unlikely event that our customer service team is unable to resolve a complaint you may have to your satisfaction, we each agree to resolve those disputes through binding arbitration or small claims court instead of in courts of general jurisdiction.

Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. We each agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision.

CLASS ACTION WAIVER: We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.

17. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws principles.

18. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
